Terms of Service

These terms are a contract between you and Webmonials governing your use of our testimonial collection and sharing service. We've kept them as readable as we can — no gotchas, no clauses we hope you won't notice. By creating an account or using Webmonials, you agree to them.

1. The service

Webmonials provides tools to collect testimonials and reviews (via hosted forms, imports, and integrations), manage them (tagging, search, curation), and share them (embeddable widgets, hosted walls of love, images, and exports). Features vary by plan as described on our pricing page.

2. Your account

You must be at least 16 years old and provide accurate account information. You are responsible for activity under your account and for keeping your credentials secure. Seats are for individual people — credentials must not be shared between users. Notify us immediately at support@webmonials.com if you suspect unauthorized access.

3. Plans, billing, and cancellation

  • The Free plan is free forever within its limits and requires no payment method.
  • Paid plans are billed in advance, monthly or yearly, through Stripe. Yearly plans are discounted as shown at checkout.
  • You can upgrade, downgrade, or cancel at any time from billing settings. Downgrades and cancellations take effect at the end of the current billing period.
  • If a renewal payment fails, we'll retry and email you before restricting the account to free-plan limits. Your content is never deleted for non-payment.
  • If you're unhappy in your first 30 days on a paid plan, email us and we'll refund you in full.

4. Your content and ownership

You own everything you put into Webmonials — your branding, your forms, and the testimonials you collect. You grant us a limited license to host, process, transcribe, and display that content solely to provide the service. We claim no other rights, and the license ends when you delete the content or your account.

You can export your data — including video files — on every plan, at any time.

5. Testimonials and consent

You are responsible for the testimonials you collect and display. You agree to:

  • Collect testimonials only from real customers, with their consent to public display.
  • Never fabricate, materially edit, or misattribute a testimonial — including using AI to generate fake reviews.
  • Honor removal requests from the people who gave you testimonials.
  • Comply with applicable consumer-protection rules on endorsements and reviews (for example, the FTC's Endorsement Guides), including disclosing incentives where required.

Fabricated or deceptive social proof harms everyone — it is the one thing that gets an account terminated without a warning first.

6. Acceptable use

You agree not to use Webmonials to:

  • Violate any law, or infringe anyone's intellectual property, privacy, or publicity rights.
  • Distribute malware, spam, or deceptive content, or attempt to breach or overload our systems.
  • Collect testimonials for products that are illegal where they're sold.
  • Resell or white-label the service itself without a written agreement with us.

7. Our intellectual property

The Webmonials software, design, and brand are ours. These terms don't grant you any rights to them beyond using the service. Feedback you send us may be used to improve the product without obligation. On free plans, Webmonials-hosted forms and walls include a small "Powered by Webmonials" badge; paid plans can remove it.

8. Service availability and changes

We work hard to keep Webmonials fast and available, but the service is provided "as is" without uptime guarantees on self-serve plans. We may add, change, or retire features; if we retire something material to your use, we'll give you at least 30 days' notice.

9. Termination

You can delete your account at any time from settings. We may suspend or terminate accounts that violate these terms — with notice and a chance to fix the issue, except for serious violations like fabricated testimonials or abuse of our systems. On termination, your content is deleted per our privacy policy, and you may export it beforehand.

10. Disclaimers and liability

To the maximum extent permitted by law: Webmonials disclaims implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We are not liable for indirect, incidental, or consequential damages, or lost profits or revenue. Our total liability for any claim is capped at the amount you paid us in the twelve months before the claim arose (or $50 on the free plan). Some jurisdictions don't allow these limits, so they may not fully apply to you.

11. Indemnity

You will indemnify Webmonials against third-party claims arising from your content, your use of the service in violation of these terms, or your violation of law — including claims from people whose testimonials you collected or displayed without proper consent.

12. Governing law and disputes

These terms are governed by the laws of England and Wales. Before filing anything, email us at legal@webmonials.com — nearly every issue is fixable with a conversation. Disputes that can't be resolved informally will be handled in the courts of England and Wales.

13. Changes to these terms

We may update these terms as the product and the law evolve. For material changes, we'll email account owners at least 14 days before they take effect. Continuing to use Webmonials after that date means you accept the updated terms.
